Motion docketed in U.S. v. Lynch

My motion was added to the docket today but postdated back to July 21 the day it was actually delivered to the court.  My name was also added to the list of parties as a "movant."  I've started a new section of the web site to track the activities, at: http://www.iowamedicalmarijuana.org/lynch/

Would patent #6,630,507 which was awarded not by, but TO the US Dept of Health and Human Services, and which states that cannabinoids are useful in the treatment and prevention of a wide variety of diseases including stroke, trauma, auto-immune disorders, Parkinson’s, HIV dementia, and Alzheimer’s, bolster the position that cannabis does indeed have currently accepted medical use for treatment in the United States?

It would, if that issue had not already been resolved. Since 12 states have accepted the medical use of marijuana, and federal law has no definition for accepted medical use of marijuana, the issue has already been resolved and the DEA has been in violation of federal law for 12 years for failing to reschedule marijuana.

This really fills me with Hope. Even if the DEA refuses to act (remove marijuana from schedule I) I feel that it will only make the DEA look even more unconstitutional. Thanks for the link Carl so we can be up to date. Perserverance is the key to winning this war of propaganda and prejudice. Peace...

Every person that gets arrested for marijuana should file a motion to dismiss based on lack of jurisdiction until marijuana is reclassified.

Thanks for that last post on what one should do if they get arrested with marijuana. Sooner or later, unless I make a run for the wall i.e.Oregon, it's bound to happen. Best of luck, Mr. Lynch deserves the Nobel Peace Prize for his compassionte MMJ dispensary not a 100 year sentence. Hell, the 84 year old Senior GOP Senator from Alaska Ted Stevens who covered up the more than $250,000 dollars for political favors will get what a 5 year suspended sentance WTF!!! This man is nothing but a low down thief, just like any other thief. Yet Charlie Lynch faces up to 100 years in prison for giving Medical Marijuana free to a 17 year old cancer patient in the presence and with the permission of his parents. As Yakof Smirinoff says, "What a F------ Country."

Wow Carl,

You did such a great service by producing this docket for Charlie's case! I went to the trial on day 1 potential jurors included a medical cannabis patient, and a woman who spoke out about jury immunity (aka nullification).

Let me know if I can ever be of help to you. I am located quite close to the courts in Los Angeles.

Hi Jessica,

The federal public defender said he was going to adopt my motion, but I don't see any record of it. The federal public defender is still arguing Tenth Amendment, which is not a strong as a federal statute, 21 U.S.C. 903, which gives the states the authority to determine accepted medical practice.

The federal public defender is also arguing entrapment because Charlie called the DEA and was told that medical marijuana was a local matter, which it is under the federal statute, 21 U.S.C. 903. However, Charlie's federal public defender is telling the court that the DEA gave Charlie bad advice. It was not bad advice. It is federal law, 21 U.S.C. 903.

Would you please give Charlie a copy of the motion I filed so that he knows it was filed. I don't think his federal public defender is telling him about it.
